From the case of VSK, the bidder offered the lowest price amount 6,150,000,000.00 baht (VAT included) which is lower than the median price, 376,973,718.58 baht (VAT included). While ITA Consortium has been considered as the winner of the bidding by MWA offered 6,460,560,000.00 baht which is higher than VSK about 310,560,000.00 baht.

VSK is confident that we are the fully qualified bidder according to the bidding announcement of MWA. VSK has appealed the procurement result to the Comptroller General’s Department, the appeal and complaints committee have the opinion that all of our offer meets the condition as the bidding announcement. Therefore, the Comptroller General’s Department has assigned MWA to review the consideration progress accurately.

However, VSK hasn’t been informed about the appeal result and there is an interview of the director of Water Production and Quality Control Division, The Metropolitan Waterworks Authority, said the consideration of the appeal and complaints committee was incorrect based on water supply engineering method. VSK deems that MWA should follow procurement procedure according to Public Procurement and Supplies Administration Act, B.E.2560 (2017).

VSK, as the qualified bidder, request MWA to take action by the appeal and complaints committee opinion as soon as possible. In order to follow the regulation and to keep the government's interest as a priority. MWA should sign a contract with VSK as the qualified bidder soon to ensure that the operation is in accordance with MWA’s plan.

If MWA has not consider protecting the government’s interest and fairness, VSK must take legal action to MWA, executive and related government officials. This action will protect state interests and society fairness not to destroy organization cooperate governance break the rules of society and legal system.
